A Lei de Acesso \u00e0 Informa\u00e7\u00e3o – LAI (Lei Federal n\u00ba 12.527, de 18\/11\/2011<\/a>), regulamentou as disposi\u00e7\u00f5es constitucionais que asseguram a todos os cidad\u00e3os o direito de receber dos \u00f3rg\u00e3os p\u00fablicos informa\u00e7\u00f5es de seu interesse particular, ou de interesse coletivo ou geral, bem como o acesso a registros administrativos e a informa\u00e7\u00f5es sobre atos de governo.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

Os pedidos s\u00e3o enviados para as Secretarias que det\u00e9m o conhecimento sobre a informa\u00e7\u00e3o solicitada sendo respondidos pelos servidores que atuam na \u00e1rea e ratificados pelo Secret\u00e1rio Municipal. Em caso das unidades de apoio direto ao Prefeito Municipal os pedidos s\u00e3o respondidos pelas autoridades m\u00e1ximas destas unidades.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

De acordo com a Lei Municipal 1.113\/2012, Art. 12.<\/strong>\u00a0No caso de indeferimento parcial ou total de acesso \u00e0 informa\u00e7\u00e3o ou \u00e0s raz\u00f5es da negativa do acesso, o interessado poder\u00e1 interpor recurso contra a decis\u00e3o, no prazo de 10 (dez) dias a contar da sua ci\u00eancia.
\u00a0\u00a0\u00a0\u00a7 1\u00ba\u00a0<\/strong>O recurso ser\u00e1 dirigido ao Secret\u00e1rio Municipal de Administra\u00e7\u00e3o, por interm\u00e9dio do Servi\u00e7o de Informa\u00e7\u00e3o ao Cidad\u00e3o – SIC, que poder\u00e1 reconsiderar sua decis\u00e3o no prazo de 5 (cinco) dias ou, nesse mesmo prazo, faz\u00ea-lo subir, devidamente informados.
\u00a0\u00a0\u00a0\u00a7 2\u00ba\u00a0<\/strong>O Secret\u00e1rio Municipal de Administra\u00e7\u00e3o dever\u00e1 proferir a sua decis\u00e3o no prazo de 5 (cinco) dias contados do recebimento do recurso, sob pena de responsabilidade.

Art. 13.<\/strong>\u00a0Indeferido o acesso a informa\u00e7\u00e3o pelo Secret\u00e1rio Municipal de Administra\u00e7\u00e3o, na forma do art. 11 desta Lei, o requerente poder\u00e1 recorrer ao Prefeito, que deliberar\u00e1 no prazo de 5 (cinco) dias se:
\u00a0\u00a0\u00a0I –<\/strong>\u00a0o acesso \u00e0 informa\u00e7\u00e3o n\u00e3o classificada como sigilosa for negado;
\u00a0\u00a0\u00a0II –<\/strong>\u00a0a decis\u00e3o de negativa de acesso \u00e0 informa\u00e7\u00e3o total ou parcialmente classificada como sigilosa n\u00e3o indicar a autoridade classificadora ou a hierarquicamente superior a quem possa ser dirigido pedido de acesso ou desclassifica\u00e7\u00e3o; e,
\u00a0\u00a0\u00a0III –<\/strong>\u00a0estiverem sendo descumpridos prazos ou outros procedimentos previstos nesta Lei.
\u00a0\u00a0\u00a0\u00a7 1\u00ba\u00a0<\/strong>Verificada a proced\u00eancia das raz\u00f5es do recurso, o Prefeito determinar\u00e1 ao Servi\u00e7o de Informa\u00e7\u00e3o ao Cidad\u00e3o – SIC que adote as provid\u00eancias necess\u00e1rias para dar cumprimento ao disposto nesta Lei.
\u00a0\u00a0\u00a0\u00a7 2\u00ba\u00a0<\/strong>Negado o acesso \u00e0 informa\u00e7\u00e3o pelo Prefeito, c\u00f3pia do expediente ser\u00e1 encaminhada ao Sistema de Controle Interno, para acompanhamento e fiscaliza\u00e7\u00e3o da sua regularidade.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t

De acordo com a lei municipal 13 da Lei Municipal n\u00ba 3.069\/2019, \u201cArt. 13.
